An on-duty Philadelphia police officer forced another man to perform oral sex until ejaculation took place last March, the alleged victim testified at a preliminary hearing May 15.
Michael A. Paige, who’s been suspended without pay, a young construction worker to perform oral sex at two different locations in the Belmont Plateau area of Fairmount Park about 2:30 a.m. March 16.
PGN is withholding the name of the alleged victim.
He told Municipal Court Judge Marsha H. Neifeld that he was sitting in his car socializing with a friend when Paige drove up and asked for his driver’s license.
The man said he didn’t have a valid driver’s license, but Paige told him his computer wasn’t working properly anyway. Rather than issuing a traffic ticket, Paige allegedly told the man to drive his friend home and then return to the park.
The man said he followed Paige’s instructions and when he returned, Paige ordered him into his police vehicle.
“Then next thing I know, he’s pulling off someplace in the woods,” the man testified. “When we got in the woods, he pulled down his pants and made me suck his thing, his penis. Then, we went to another part of the woods. He made me do oral sex with him again. He ejaculated, [then] got himself together, took me back to my car — and that was it.”
The man said Paige’s gun was in its holster on the patrol car’s floor during the alleged sexual assault.
Defense attorney Gerald S. Stanshine asked the man why he didn’t grab the gun when Paige reportedly left the car to urinate.
But the man said he feared other police officers would be called to the scene and that he would be killed before he could tell his version of events.
“I thought about blowing [Paige’s] head off,” the man said. “But would I make it out alive? I’m no dummy. I know that cops protect one another. I have a mother and a sister who care about me. I thought about getting home in one piece.”
Stanshine also asked the man why he would follow Paige’s alleged commands so freely. The man responded by noting that Paige was in a position of authority.
“I’m with an officer, so I know I better be OK,” the man testified.
The man also insisted he didn’t voluntarily perform oral sex on Paige. “Absolutely not,” he said. “I didn’t want to do that.”
After the alleged sexual assault, the man said he gave Paige his cell phone number, hoping Paige would call him so Paige’s phone number would appear. When Paige called the following day, the man recorded Paige’s phone number, which helped authorities identify the officer, the man testified.
Paige, 40, of Nicetown, did not make a statement at the hearing and declined to comment to PGN. He remains free on $100,000 bail.
In April, Paige was suspended without pay from the police force and is expected to be permanently dismissed after the 30-day suspension period, according to police.
Neifeld held Paige on charges of involuntary deviate sexual intercourse, unlawful restraint, indecent assault, official oppression and related charges. The judge dismissed the charge of kidnapping.
Stanshine said Paige would wage a vigorous defense of the criminal charges, but he declined to comment on whether Paige would attempt to return to the police force.
“I don’t think [the alleged victim] is being truthful about what happened,” Stanshine told PGN after the 60-minute hearing. “My client will fight this case all the way through to the end to clear his name from these slanderous charges.”
Paige’s arraignment is scheduled for 8 a.m. June 5 in Room 705 of the Criminal Justice Center, 1301 Filbert St.
